All approved SC Affiliates will have their sites posted in our Best Links Directory. When surfers access our Awards Application Page they will be offered a 15% discount on all our awards and submission services provided they access the site via a link from one of our affiliate sites. This has been set up so that those that find us via
a Web search will be encouraged to visit one of our affiliate sites. So not only do they get a 15% discount, but you may just get an important site visitor.

The following are the terms and conditions of participating in the Surfers Choice (a site owned and operated by The Technomax Group a duly registered and incorporated Company in the Province of Ontario, Canada) Affiliate Program. "Affiliate" or "Member" refers to yourself, and "SC" refers to us, Surfers Choice.
SC reserves the right to amend this agreement as needed from time to time, and Affiliate agrees that any such amendment will apply to Affiliate, provided Affiliate is notified and agrees to such changes via acceptance thereof on this Web site. It is Members intention to earn compensation through Member's Web site by referring leads to the Surfer's Choice Web site.
Surfers Choice and Members hereby agree to the following terms and conditions.
1) Spam - Affiliate agrees to not utilize SPAM (sending of unsolicited Commercial e-mail) in promoting Surfers Choice. This action may result in the immediate suspension or termination of Affiliate account with a cancellation of any pending commissions. Affiliate will also be in violation of the SC Affiliate Agreement and subject to legal action and be held liable for any financial loss incurred by SC. Any service interruptions to SC as a result of Affiliates spamming will be billed to Affiliate at 150 U.S. dollars per hour until service is restored.
For the purpose of this agreement SPAM is defined as emailing ANYONE, in bulk or by single mailing, about the SC Affiliate Program, who has not specifically requested the information directly from Affiliate. The ONLY exceptions to this are:
1. Mailing to APPROPRIATE OPT-IN mailing lists where the source does the mailing on Affiliate's behalf. However, use extreme caution when choosing an opt-in mailing list company! Using anything but the most reputable sources could generate spam complaints against Affiliate resulting in suspension or termination.
2. You may include information on SC in email Acknowledgement Messages for orders and inquiries that you receive so long as it is stated up front that you will be sending them an acknowledgment.
SC also considers ANY type of advertisement about SC posted to a Newsgroup or Chat Room to be spam. Violators will be fined at 100 U.S. dollars per incident.
2) Commissions and Payments
Affiliate shall be paid a commission equal to 15% of the Gross amount of any completed sale. Such payments will be mailed to Affiliate's address about the 15th day of the month. If a sale is canceled or refunded the subject amount will be deducted from the next commission check. A minimum of $25 US must be accumulated in Affiliate's account before a check is issued.
3) You must have a quality Web site from which to post the SC Affiliate creative materials.
4) Your Web site does not contain or promote, or Link to Web sites that contain or promote, any of these types of content: libelous, defamatory, 'adult,' obscene, pornographic, abusive, violent, bigoted, hate-oriented, illegal, cracking, hacking or warez, or that offers any illegal good or service.
5) You must operate with integrity and upstanding morals.
6) Affiliate agrees that a SC Affiliate is an independent contractor, and not an employee, agent, partner, legal representative, or franchisee of SC. Affiliate further agrees not to incur any debt, expense, obligation on behalf of, for, or in the name of SC.
7) All Affiliate Applications are subject to approval by SC. This regardless of the fact that an e-mail may be sent to you upon completing the form on the preceding page. In the event that your site is not approved, you will be notified and removed from the Affiliate Program.
8) You must be of legal age in your Country and cannot enter into this Agreement unless you can enter into a contract.
9) Affiliate will be issued an "Affiliate Link", or unique URL, which allows SC to identify visitors from Affiliate site as originating from Affiliate. To receive commissions, Affiliate must use the provided Affiliate Link. The URL may be in various forms such as a banner, image, or text link.
10) Affiliate must undertake to ensure that links are properly setup and working. SC cannot pay commissions if there is faulty reporting from Affiliate's Web site
11) SC is not responsible for technical problems, acts by third parties, or other events outside our reasonable control which may temporarily disrupt or diminish service. We will provide every reasonable effort to assure accurate tracking of Affiliate sales, but cannot guarantee 100% reporting for situations that are not within our control.
12) This Agreement is non-assignable.
13) SC makes no warranties expressed or implied with regard to Affiliate Program except as outlined in this Agreement.
14) Both SC and the Affiliate reserve the right to terminate this agreement at any time. The term of this Agreement shall be for a period of six months from the date hereof and shall automatically renew upon each anniversary, without further act of the parties, unless either party has terminated this Agreement by written notice to the other. If terminated, outstanding commissions at time of termination shall be paid in the next payment so long as the terms of this agreement were not violated by the Affiliate. Payment of the final commission payment to the Affiliate may be withheld for a reasonable time in order to ensure that the correct amount is paid.
15) In the event that a provision to this Agreement is held to be invalid or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the balance of the Agreement will remain in full force and effect.
16) Affiliate cannot use SC logos, trademarks or logos other than is their intended legal use.
17) This Agreement shall be governed in accordance with the Laws of the Province of Ontario, Canada.
